(INDIANAPOLIS) - The attorney for Colts linebacker Josh McNary says he will be using the “crying wolf defense” in his client’s rape trial.
Attorney Ed Schrager says the victim has made false accusations of rape in the past and that his office received an anonymous letter that said the victim was fired from a restaurant on Massachusetts Avenue for falsely accusing someone of rape.
The defense wants to subpoena the restaurant for the victim's employment records.
McNary is accused of rape, criminal confinement and battery in the alleged incident at his downtown apartment on December 1, 2014. A trial date has not been set but the defense and prosecutors say it should be sometime in June.
