(INDIANAPOLIS) - A judge has greenlighted a federal lawsuit brought against a central Indiana jail by an amputee who fell from an upper bunk and was injured when he damaged his prosthetic leg.
The judge decided earlier this month that the American Civil Liberties Union of Indiana and Anthony Overla can continue pressing for damages from the Tippecanoe County Sheriff's Office. The Indianapolis Star reports the lawsuit alleges the jail personnel were aware that Overla uses a prosthetic leg but ignored repeated requests for a bottom bunk.
The lawsuit says that the upper bunk didn't have a ladder, forcing Overla to jump down, and causing a part of the prosthetic leg to pierce his stump.
Overla says he was denied medical treatment and the injury developed into an MRSA infection.
