(INDIANAPOLIS) - Indiana’s highest court has cited juror misconduct in overturning a central Indiana couple’s convictions in a toddler’s 2013 death at their home day care.
Indiana Supreme Court Justice Brent Dickson wrote in Tuesday's opinion that an alternate juror's disruptive actions impacted jury deliberations that led to Daniel and Saundra Wahl's involuntary manslaughter convictions.
The couple was sentenced to two years in prison in the death of a 21-month-old boy found wedged at his neck between a wall and part of a baby gate at their Fishers day care.
The Indianapolis Star reports Dickson wrote that before the Wahls were sentenced, a juror emailed the trial judge describing the disruptive actions of the alternate juror.
The court found that the alternate juror's actions had indeed impacted jury deliberations.
