(TERRE HAUTE) - A federal appeals court says a former central Indiana sheriff’s deputy convicted of civil rights violations should get a new sentence from a different judge.
The Terre Haute Tribune-Star reports a three-judge panel of the Seventh Circuit Court of Appeals released a ruling Monday that 40-year-old Terry Joe Smith of Greencastle was given a "light sentence" by U.S. District Judge William T. Lawrence in Terre Haute.
The newspaper says it could be two to three months before a new sentencing date is set.
The former Putnam County deputy was found guilty in 2014 of using excessive force on two people he arrested. An appeals court rejected the sentence in 2016, calling it too lenient, and he was resentenced by Lawrence to the same 14-month sentence he received originally.
