(INDIANAPOLIS) - The House Judiciary Committee heard HB 1115 Friday authored by Rep. Hamilton and Rep. Culver on landowner immunity for trail access.
The bill amends a current law to include limitations on a landowner's liability for an injury to a person or property caused by an act or failure to act of another person using the landowner's premises for certain recreational purposes, including a person going on or through the premises for the purpose of accessing a trail, a greenway, a park, or another similar area used for recreational purposes.
An amendment was adopted removing owner liability for injury to a person or property caused by a malicious or illegal act of the owner or occupant. Testimony was heard in support of the amended bill by a landowner as well as an insurance industry representative. The bill amended passed 9-0.
