BEDFORD – Lawrence Superior Court II Judge Bob Cline sentenced a Michigan City woman to 850 days in the Indiana Department of Correction Thursday.
Alicia R. Diviney, 22, pleaded guilty to charges of possession of methamphetamine, a Level 6 felony, and battery, a Class “B” misdemeanor, in September, as a part of a negotiated plea agreement with the State of Indiana.
She was originally sentenced to 910 days, with time served, and the remainder of her sentence suspended. She was ordered to serve a year on supervised probation in exchange for her guilty plea.
Diviney was ordered to report to probation immediately upon leaving the courtroom or immediately upon her release from jail or at 8:30 a.m. on the next business day following her release from jail, whichever is sooner.
However, Diviney failed to report to probation as ordered by the court.
A petition to revoke a suspended sentence warrant was filed with the court on October 11, 2022, and Diviney was subsequently arrested on October 19, 2022.
Because of that probation violation, Cline sentenced Diviney to 850 days in the Indiana Department of Correction.
“Judge Cline would prefer defendants to inform his Court if they are unable or unwilling to adhere to the terms and conditions of their plea agreements. Diviney was advised of, and she accepted, the terms of her plea agreement and then immediately refused to perform said terms. The result was a prison sentence,” said Lawrence County Deputy Prosecutor Robert Garrett.
