MITCHELL – A Mitchell man was arrested Friday on charges of domestic battery on a physically disabled person and interfering with reporting a crime.
According to a probable cause affidavit, on Sunday, November 13, 2022, at 4:55 p.m. officers were called to the 1000 block of Elm Park Drive after a report of an unwanted male.
While en route police received a second report that an officer had responded to the same address earlier in the day after a report of a domestic fight.
When police arrived they were met at the door by a female. She told police that 55-year-old Barry Bundy had willingly left the residence earlier and said he would not return after the domestic fight. Officers asked Bundy why he had returned to the home.
He told the officer “he thought everything was fine”. He then began to argue with the woman and another male at the home over the incident that had occurred earlier.
Bundy called his brother-in-law and asked him to come to pick him up. The officer stayed on the scene until Barry left the home.
After Bundy left, the officer went back to the home to give the woman information about the Hoosier Hill PACT 24-hour crisis hotline. At that time, the woman told police that Bundy had grabbed the other male in the home causing him some pain.
The officer asked the woman why they didn’t want to pursue charges and she told officers they were not asked at the time about filing charges. The physically disabled male told the officer he would sign a battery affidavit. The male is non-ambulatory and has no use in his legs. The male told the officer that Bundy had allegedly grabbed him by his left wrist and continuously jerked it causing pain to his wrist.
The man told the officer he worries about his safety when Bundy is around because Bundy is a heavy drinker. The officers also confiscated a .22 rifle in the home for the duration of the case.
The woman reported that Bundy was angered when he discovered the family puppy had chewed on his glasses. That is when Bundy allegedly began screaming, throwing, and kicking items. He kicked a space heater that bounced off the disabled man. When the disabled man attempted to grab his cell phone to call 911, Bundy allegedly grabbed the phone from him. The woman was able to retrieve the phone when Bundy eventually threw it and she returned it to the disabled man, who called 911.
She told police that Bundy had been drinking since Friday night and continued all day Saturday and had also taken pain pills. The woman stated Bundy’s general behavior is verbally and mentally abusive to both her and the disabled man, regardless of the drinking situation.
