ELLETTSVILLE — A man facing charges connected to an Indiana University student’s death is now facing a charge of rape in a 2021 Ellettsville case.
Eric Montgomery, 33, of Bloomington has been charged with rape.
He is also facing charges in connection with the August 2022 death of 20-year-old IU student Avery McMillan.
According to court documents, a woman contacted the Ellettsville Police Department in August 2021 to report her neighbor Eric Montgomery had raped her. The woman claims Montgomery came to her house distraught about a family member’s death. She let him in her apartment when she gave him a hug to comfort him he kissed her and sexually assault her.
The woman told police she told Montgomery no numerous times.
The charges were filed after an investigator got a DNA sample from Montgomery after he was arrested in connection with McMillan’s death. The sample was compared to the sexual assault evidence collection kit collected in August 2021. On January 3, the document states investigators learned that the samples matched.
