Orleans man who caused fatal accident violates terms of probation sentenced to prison

BEDFORD – Lawrence County Superior Court I Judge John Plummer III sentenced a Orleans man to prison.

Andy Evans, 55, pleaded guilty to causing death while driving while intoxicated. He had a blood alcohol content of more than 0.15 percent during a negotiated plea deal.

He was sentenced to 12 years in prison with four years suspended to supervised probation.

But Evans continued to violate the terms of his probation. Judge Plummer revoked Evans’ suspended sentence. Evans was ordered to serve 354 days in prison and was given credit for 56 days served.

“This Defendant served time at the Indiana Department of Correction, where he had the opportunity to better himself before he returned to the community,” said Chief Deputy Prosecutor Joshua Scherschel. “He failed to take the necessary steps to rehabilitate himself, and when he was released into the community, the Defendant continued to disobey the court’s order. Sending the Defendant back to prison to finish his sentence.”

Evans was involved in the fatal accident on Spice Valley Road on June 26, 2016.

Donald G. Parsons, 53, died from head injuries, according to a Lawrence County Police Department accident report. Parsons was transported to a hospital by ambulance and later died of his injuries.

Evans, who was 47, also suffered a head injury. He was airlifted to a hospital by an Air Evac unit.

The report stated that at 8:45 p.m., a woman who lives close to the accident scene reported a crash in the 2600 block of Spice Valley Road. The witness said she heard the crash and found a gray 2001 GMC Sierra, driven by Evans, that had hit a tree head-on. She said Evans got out of the truck, then tripped and fell to the ground after the crash.

While relaying information to police, the woman said three people stopped to help Evans and his passenger, Parsons.

Police say the truck was traveling west on Spice Valley Road before it ran off the road for an unknown reason. The vehicle went off the right side of the road and struck several small trees and bushes before hitting another tree head-on. Evans’ airbag deployed, but Parsons’ did not because it was turned off.

According to the report, neither Evans nor Parsons could communicate with medical personnel.

Marion Township Rural Fire Department and Mitchell Police Department assisted at the scene.
