BEDFORD—A Mitchell man will spend time in prison after failing to comply with his probation terms.
Christopher E. Agan, 41, pled guilty to conspiracy to commit trafficking with an inmate, a Level 5 felony, as part of a negotiated plea agreement with the State of Indiana.
Lawrence Superior Court I Judge John Plummer III sentenced Agan to five years in the Indiana Department of Correction with four years and 183 days of that sentence suspended to supervised probation.
After violating his probation terms and conditions, Judge Pummer revoked Agan’s suspended sentence and sentenced Agan to four years in the Indiana Department of Correction. Agan was given credit for 73 days served in jail.
“This Defendant was given the opportunity to remain in the community and seek treatment for his addiction. Probation is a privilege and not a right,” said Chief Deputy Prosecutor Joshua Scherschel. “A Defendant doesn’t get to pick and choose what portions of probation they want to complete. Prison was the appropriate result.”
