BEDFORD – On November 27, Alex D. Flynn, 29, of Bedford, was sentenced to the Indiana Department of Correction after violating the terms of his probation. Lawrence Superior Court I Judge John M. Plummer III handed down the sentence.
Flynn had previously pled guilty to charges including battery by means of a deadly weapon, a Level 5 felony, unlawful possession of a firearm by a domestic batterer, a Class A misdemeanor, and domestic battery, a Class A misdemeanor. As part of a negotiated plea agreement, Flynn was sentenced to 344 days in the Lawrence County Jail and seven years in the Indiana Department of Correction, with seven years of that sentence suspended to supervised probation.
However, after violating the conditions of his probation, Judge Plummer revoked the suspended sentence and resentenced Flynn to serve the entire seven years in prison. Flynn was given credit for 13 actual days already spent in jail.
Chief Deputy Prosecutor Joshua Scherschel emphasized the seriousness of the violation, stating, “This Defendant was allowed to stay in the community and work with probation to rehabilitate his life. However, this defendant chose which probation terms to follow and which not to follow. You do not get to pick and choose what you want to do while on probation, and the prison was the appropriate result.”
Flynn’s sentencing serves as a reminder of the importance of adhering to the terms of probation and the consequences of failing to do so.
