Previously, Smith was sentenced to 910 days, with 896 days suspended, and placed on probation for 545 days starting June 13, 2024, with a scheduled end date of December 9, 2025. However, probation violations began to surface shortly after.

On August 2, 2024, Smith failed an oral fluid drug screen, which tested positive for Delta-9 THC. Later, on November 25, 2024, he failed another drug screen, testing positive for amphetamines and methamphetamines.
