Mitchell Police Department Reserve Officer McMillan initiated a traffic stop on State Highway 37 after observing Ortiz traveling at approximately 75 mph in a 55 mph zone. Officer Blackwell arrived at the scene to assist due to the odor of marijuana emanating from the vehicle.

Ortiz admitted to believing the speed limit was 75 miles per hour. A search of the vehicle, conducted after the detection of marijuana odor, revealed a “blunt,” a bong, a device used with THC wax, a jar of THC wax, a blowtorch, and a half-empty bottle of vodka.

A portable breath test administered at the scene showed a blood alcohol content of 0.158. Ortiz admitted to having consumed alcohol.

Following field sobriety tests, another breath test was administered, resulting in a blood alcohol content of 0.170.

A subsequent breath test at the Lawrence County Jail registered a blood alcohol content of 0.154. The chemical blood test results are pending.

Ortiz was remanded to the Lawrence County Jail.

Those facing criminal charges are considered innocent unless convicted through due legal proceedings. Accusations alone do not imply guilt; the judicial system will evaluate the presented evidence to reach a verdict.
