
BLOOMINGTON — Eric Manual Montgomery, already serving a 36-year sentence for the rape and related charges surrounding the death of an Indiana University student, has pleaded guilty to an additional rape charge.

The new plea stems from a 2021 incident in Ellettsville where Montgomery raped a neighbor.
Under the plea agreement, Montgomery will serve 10 years for the Ellettsville rape concurrent with his existing 36-year sentence. He pleaded guilty on March 13, 2025, and sentencing is scheduled for March 27.
The victim in the 2021 case reported that Montgomery, claiming emotional distress, came to her residence and subsequently assaulted and raped her. DNA evidence later linked Montgomery to the crime.
Montgomery’s existing sentence is connected to the 2022 death of IU student Avery R. McMillan, who died of a fentanyl overdose. Montgomery was convicted of rape, obstruction of justice, and furnishing alcohol to a minor in that case. Evidence showed Montgomery had met McMillan, brought her to his residence, and provided her with alcohol and drugs.
