
INDIANA—The House Courts and Criminal Code Committee has approved Senate Bill 219, a bill relating to criminal trespass. The bill, authored by Senator Bill Clark and sponsored by Representative Wendy McNamara, outlines the specific circumstances under which a person commits criminal trespass, a Class A misdemeanor.


According to the bill, an individual commits criminal trespass if, without a contractual interest in the property, they knowingly or intentionally:
- Enter the real property of another person after being denied entry by the other person, that person’s agent or a law enforcement officer acting on behalf of the other person or their agent.
- Refuse to leave the real property of another person after being asked to leave by the other person, that person’s agent or a law enforcement officer acting on behalf of the other person or the other person’s agent.
The Indiana Sheriffs’ Association testified in support of the bill, which the committee passed by a vote of 13-0.
