Man sentenced to prison after violating the terms of his probation

BEDFORD – Lawrence Superior Court I Judge John Plummer III sentenced a Mitchell man to two years and 96 days in the Indiana Department of Correction after violating the terms of his probation.

Brandon Summers, 42, pleaded guilty to a Level 6 felony charge of possession of methamphetamine, as a part of a negotiated plea agreement with the State of Indiana in 2022. Charges of maintaining a common nuisance, possession of marijuana, driving while his driver’s license was suspended and possession of drug paraphernalia was dismissed.

“Mr. Summers was given ample opportunity to succeed and was unsuccessful. Hopefully, he will take advantage of the programs offered at the Indiana Department of Corrections and take steps to improve his life,” said Prosecutor Samuel C. Arp II.

Summers was sentenced to two years and 182 days in jail, he was given credit for 19 days served and Judge Plummer suspended two years and 144 days. Judge Plummer ordered Summers to serve two years on supervised probation.

After violating the terms of his probation, a warrant was issued for Summers’ arrest for petition to revoke his suspended sentence.

On March 20th, Judge Plummer revoked Summers’ suspended sentence and he will now serve two years and 96 days in the Indiana Department of Corrections. He was given credit for 16 days served.
