OOLITIC – A Mitchell woman was arrested on numerous charges after Oolitic Town Marshalls responded to 109 4th Street at 12:37 p.m. on Wednesday, April 12, after a report of an unwanted person at the residence.
Police learned that 42-year-old Penny Duncan had arrived at the residence after being served an eviction notice, and attempted to make forced entry into the residence.
Dispatch told the officers that Duncan was sitting outside of the residence in her vehicle and attempting to flee. The caller also reported Duncan was intoxicated.
When police arrived the caller reported Duncan had arrived at the residence and attempted to force open the door. Officers found marks and dents on the front door where Duncan had attempted to force the door open.
Police found Ducan in her vehicle parked in front of the home with the motor running.
Duncan who was intoxicated exited the vehicle, leaned on the car sobbing, and was yelling at the officers. She then stated she “pleaded the 5th”.
Duncan denied the allegations of attempting to break into the home.
While securing her vehicle, an officer observed a 750 ml bottle of ‘Dark Eyes’’ 80-proof vodka in the passenger floorboard that was approximately half empty.
Duncan performed a portable breath test and had a blood-alcohol content of 0.229.
Duncan was arrested on charges of operating a vehicle while intoxicated with a prior conviction, OWI endangerment, attempted residential entry, criminal mischief, and criminal trespass.
