Woman arrested after not sending her child to school

MITCHELL – Kayla McIntosh, 32, of Mitchell, is facing a charge of neglect of a dependant after an investigation on February 28, 2023.

According to a probable cause affidavit, on that day at 1:50 p.m. Mitchell Police Sgt. Rob German was contacted by Mitchell Junior High School Assistant Principal Rickie Mason about a report of neglect.

The principal reported McIntosh’s child had missed 87.5 days of school. Principal Mason advised, a student may miss a maximum of 15 “non certified” days of school, per the Mitchell Community Schools student handbook.

Principal Mason said he had advised McIntosh about her child missing school.

Sgt. German made a home visit on November 9, 2022. On that day, the student had missed 23.5 days. Sgt. German told McIntosh he was concerned about the student’s attendance.

At that time the school did not want to file charges. The child refused to go to school on that day and the child was currently failing all of her classes. Principal Mason advised, the child’s current grades are not a reflection on her academic abilities. Principal Mason stated the child has passing grades, when she is in attendance.

Principal Mason believes McIntosh was depriving her child of an education.

The information was forwarded to the Lawrence County Prosecutor’s office and a warrant was issued for McIntosh’s arrest.
